Terms of sale

1. General provisions

These terms of sale govern the legal relationship that arises between A-Velg OÜ (registry code 11703911, VAT number EE101316923, address Ringtee tn 1, 50105 Tartu, Estonia) and the customer when purchasing goods and booking services via the A-Velg online store at www.avelg.ee.

These terms apply to all contracts concluded through the online store. By placing an order or booking a service, the customer confirms that they have read these terms and agree to comply with them.

In addition to these terms, the laws of the Republic of Estonia apply, in particular the Law of Obligations Act (VÕS) and the Consumer Protection Act (TKS), and — for the processing of personal data — the General Data Protection Regulation (GDPR) and the A-Velg OÜ privacy policy.

2. Ordering

To place an order, select the products you want, add them to the cart and follow the checkout steps: enter your contact details, choose a delivery method and complete payment.

The contract of sale is deemed concluded once the payment has been received in the A-Velg OÜ account. The customer will receive an order confirmation by email together with the order number and a PDF invoice. If no confirmation arrives within 24 hours, please contact us at info@avelg.ee.

A-Velg OÜ has the right to cancel an order if:

  • The product is not in stock and the supplier cannot deliver it within a reasonable time.
  • The price in the online store is significantly incorrect due to an obvious data-entry or technical error.
  • The customer’s payment has not been received within 3 business days of placing the order.

If an order is cancelled, the customer is notified without delay and any amounts paid are refunded within at most 14 days to the same account from which the payment was made.

3. Prices

All prices shown in the online store are in euros and include VAT (24%). Delivery fees are added according to the chosen delivery method and are shown to the customer before the order is confirmed.

The price that applies is the one shown in the online store at the moment of placing the order and making the payment. If, after the order has been placed, it turns out that the price was affected by an obvious error, A-Velg OÜ has the right to cancel the order in accordance with the “Ordering” section.

4. Payment

Payments are processed via LHV Bank (the EveryPay payment gateway). The following payment instruments are available:

  • Estonian bank links: Swedbank, SEB, LHV Pank, Luminor, Coop Pank.
  • Credit and debit cards (Visa, Mastercard).
  • Hire purchase: Esto AS and Holm Bank AS — subject to the conditions and minimum amounts of the relevant financier. Approval of a hire-purchase application depends on the financier’s credit decision.

A-Velg OÜ does not store credit or debit card data. After a successful payment, A-Velg OÜ sends the customer a PDF invoice by email.

If a payment cannot be completed, the customer can return to the cart and try again. An unpaid order is automatically cancelled after 3 business days.

5. Delivery

A-Velg OÜ offers the following delivery methods:

  • Smartposti parcel locker — domestic delivery typically within 2–4 business days.
  • Venipak courier service — delivery to the customer’s address typically within 1–3 business days.
  • Free pickup from the A-Velg OÜ store at Ringtee tn 1, 50105 Tartu.

Delivery times are indicative and may vary depending on product availability, the workload of the transport partner and, for bulky items (e.g. wheel sets), the need to arrange suitable transport.

Please check the condition of the packaging and contents on receipt. Visible damage must be recorded in the presence of the transport partner (courier or parcel-locker representative) and reported to A-Velg OÜ within 24 hours of receipt by email at info@avelg.ee.

6. Service bookings

Through the online store’s booking system, you can order workshop services (tyre change, rim repair and painting, wheel alignment, oil change and others). To complete a booking, choose a service, time slot and vehicle type, and fill in your contact details and vehicle data (including the registration plate).

Depending on the service, an advance payment or full payment in the online store may be required to confirm a booking. The final price is confirmed on site after the vehicle has been inspected and may change if the scope of work differs from what was indicated in the booking; we will inform the customer of any significant price differences before any work is started.

A booking can be cancelled or changed free of charge while it is in “pending” or “confirmed” status, by contacting us at info@avelg.ee or +372 5551 7328. A reasonable notice is at least 24 hours before the booked time slot; for later cancellations or no-shows, A-Velg OÜ has the right to charge a reasonable fee for the time already reserved.

Where possible, refunds are made to the same account or card from which the payment was originally made.

7. Right of withdrawal and returns

A consumer customer has the right under § 56 of the Estonian Consumer Protection Act (TKS) to withdraw from goods purchased through the online store within 14 days of receipt by submitting a written withdrawal notice to info@avelg.ee. We can provide a sample withdrawal form on request.

Returned goods must be:

  • Unused, in a condition suitable for resale and, if possible, in their original packaging.
  • Complete, including all related parts and documents.
  • Packed so that the goods can be transported back without damage.

The direct costs of returning the goods are borne by the customer, except where the reason for return is the fact that A-Velg OÜ has shipped a wrong product or one that does not conform to the contract. If the goods have lost value due to use beyond what is necessary to inspect them, A-Velg OÜ has the right to reduce the refund by an amount corresponding to that loss in value.

The refund is made within at most 14 days of receiving the withdrawal notice, but not before A-Velg OÜ has received the returned goods or the customer has provided proof of return shipment. The refund is made to the same account or payment instrument from which the payment was made.

8. Claims and warranty

Customers have the right to file a claim against A-Velg OÜ for 2 years from the delivery of the goods, in accordance with §§ 217–225 of the Estonian Law of Obligations Act and the Consumer Protection Act. During the first six months any defect is presumed to have already existed at the time the goods were handed over.

In addition, a manufacturer’s commercial warranty may apply to the product, the conditions of which are set out in the product information or the manufacturer’s documentation. A claim will not be honoured if the defect has arisen for one of the following reasons:

  • The product has been used, fitted or stored contrary to the manufacturer’s instructions, or on an unsuitable type of vehicle.
  • The product has been repaired or modified by a person who is not authorised or qualified to do so.
  • The damage is due to normal wear and tear, an accident or another external influence.

To file a claim, please contact us at info@avelg.ee, including your order number, a description of the goods, a description of the defect and, where possible, photos. We aim to provide a first response within 5 business days and to resolve the case within a reasonable time.

9. Sales to legal persons

If the customer places an order as a legal person, marks the buyer type as “business” and provides a registry code and VAT number, the transaction is treated as a B2B sale. In that case the 14-day right of withdrawal — which by law applies only to consumers (§ 56 TKS) — does not apply.

For legal persons the general rules on claims and conformity laid down in §§ 217–237 of the Law of Obligations Act apply. Additional terms may be agreed with the legal person separately in writing.

10. Liability and force majeure

A-Velg OÜ is liable for direct material damage caused to a consumer by a breach of these terms to the extent provided by law. Liability is generally limited to the amount paid for the order in question, except in cases of intent or gross negligence.

A-Velg OÜ is not liable for disruptions caused by force majeure, including but not limited to power outages, communication failures, disturbances in the activity of contractors and transport partners, strikes and natural disasters. In a force majeure situation, delivery and work deadlines are extended reasonably until the obstacle has been removed.

11. Resolution of disputes

For any questions or complaints related to orders and services, please first contact us at info@avelg.ee. We will try to find a solution by negotiation.

A consumer customer can also file a complaint with the Consumer Disputes Committee of the Estonian Consumer Protection and Technical Regulatory Authority (https://komisjon.ee). Consumers in the European Union can additionally use the European Commission’s online dispute resolution platform: https://ec.europa.eu/odr.

These terms are governed by the law of the Republic of Estonia. Disputes are resolved in the courts of Estonia; for contracts with consumers, in Tartu County Court (Tartu Maakohus), unless the parties agree otherwise.

12. Changes to the terms

A-Velg OÜ has the right to amend these terms of sale from time to time. Amended terms enter into force when published on the website. The terms applicable to a specific order or booking are always those that were in force at the time the order was placed or the booking was confirmed.
